A majority of the time when you decide to sell home, it is likely that you will choose a real estate brokerage firm to assist you with scheduling open houses and showings, and helping you negotiate a preliminary contract. Many first-time sellers may not know that after the initial contract is signed, the clock is ticking to ensure that the parties complete this portion of the closing by entering and ultimately concluding Attorney Review. Mr. Scotto D’Aniello personally deals with each of his clients to ensure that all of their questions answered, but further to assist his clients through any contract negotiations throughout the entire closing.

Attorney Review

Once the initial contract is signed, the parties will enter into a period of the closing that is known as the Attorney Review. Many times, a Realtor presents you with a standard contract known as the “Statewide New Jersey Realtors Standard Form of Real Estate Sales Contract”. During this pivotal part of the Closing, Mr. Scotto D’Aniello will review the contract to ensure that all of your interests are protected, and will also attach a Rider or Addendum to the contract which contain specific or additional provisions that may have been discussed between the parties, but may not have been included at the time the contract was signed. Once the parties are able to agree upon all additional provisions of the Contract, the Attorney Review portion of the Closing is completed and you are one-step closer to selling your property!

Inspection Contingency

Once Attorney Review is completed, and so long as it is agreed by the Parties, Buyers will now have the ability to conduct an inspection of the property. Unfortunately, many times clients encounter a Buyer that attempts to nit pick at every small and insignificant issue that may exist with the home. Mr. Scotto D’Aniello personally reviews the inspection report and request for inspections with each of his client. He assists with the negotiation of any issues to ensure his client’s rights are protected to place his clients in the most secure and financial position. Furthermore, Mr. Scotto D’Aniello ensures that the items Buyers may specifically request Sellers to remediate or provide a credit for are actually covered as a protected issue. For example, many times a Buyer wishes the Seller to replace, exchange, or provide a credit for an appliance that although may be past its average life expectancy, still is properly functional and working at time of inspection. Mr. Scotto D’Aniello works diligently to ensure that only structural, mechanical, or environmental issues will be addressed at the time of inspection, so long as the Seller is in agreement of this at the time of Attorney Review. Most importantly, Mr. Scotto D’Aniello negotiates to ensure that his client’s interests are protected.

Title Commitment

It is critical that the Title of the property be clear and able to be transferred to the prospective Buyer at time of closing. Mr. Scotto D’Aniello will handle all necessary paperwork relating to the title of your Property. He also assists his clients in resolving any liens, judgments, or issues that arise as a result of a Title search, and assists his clients with the negotiation of potential liens to ensure that Title is transferred free and clear and without issue.

Closing

Mr. Scotto D’Aniello will also personally draft all of the necessary conveyance documents to include the Deed, Affidavit of Titles, Certifications, and other necessary closing documents ahead of closing. Mr. Scotto D’Aniello meets with each of his clients to review the conveyance documents to execute and sign, and personally appears at each closing on behalf of his clients to ensure that no issues arise on the day of Closing. Mr. Scotto D’Aniello also assists his clients to obtain the necessary Certificates of Occupancy (“CO”) as well as smoke detector and carbon monoxide detector certificates from the municipality prior to closing. Many of times, his clients need the proceeds of this current sale for home that they are under contract with to purchase. He ensures that all necessary and pending mortgages or credit lines are paid off and discharged, will handle all necessary issues regarding escrow, and ensures that his clients timely and expeditiously receive any proceeds from the Closing!
